What Governs Interscholastic Inclusion?
Section 504 of the Rehabilitation Act of 1973.
"No otherwise qualified individual with a disability in the United States, as defined in section 705 (20) of this title, shall, solely by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance or under any program."
Public institutions like school districts, colleges and universities all receive federal funding. Under the 504, public entities cannot:
- Deny a qualified individual with a disability the opportunity to participate
- Afford an opportunity that is not equal to that afforded to others
- Provide an opportunity that is not as effective as that provided to others
- Or provide an opportunity that is different or separate unless it is as effective as those provided to others
- Public entities must provide benefits and services of their education programs in the most integrated setting appropriate

The OHSAA recognizes the following categories for the para swim division:
Category One – Non-ambulatory (uses a wheelchair) with limited use of all four extremities.
Category Two – Dwarfism, multiple limb deficiencies, ambulatory with assistance, can use a wheelchair with a high functioning upper body.
